Michigan’s legal limit for drivers under 21

On Behalf of | Jun 7, 2022 | Blog, Criminal Defense

A drunk driving case could turn many aspects of your life on end, whether your child faces these allegations or you are a young driver accused of this offense. For example, drunk driving charges could interfere with your career in the future, and it could also jeopardize your education. You could face overwhelming anxiety and struggle with court-imposed penalties.

It is especially important for young drivers to realize that the legal limit for those under the age of 21 is much lower. Some teens face drunk driving charges because they are not familiar with Michigan’s zero-tolerance policy.

Reviewing the legal limit

According to the Michigan State Police, the legal limit for drivers over the age of 21 is .08. However, it is against the law for drivers under the age of 21 to drive with a bodily alcohol content level of .02 or higher. With such a low legal limit, some young drivers face drunk driving charges unexpectedly, and some are wrongly accused of drunk driving.

Factors that can put young drivers over the legal limit

As a young driver, you could face unique challenges that increase your chances of becoming charged with drunk driving. For example, with such a low legal limit, even a very small amount of alcohol could lead to drunk driving charges, which can become especially difficult as a result of peer pressure. Some drivers consume mixed drinks at parties without realizing the alcohol content of the beverages, and factors such as an empty stomach can also affect your BAC level.

If you currently face allegations of drunk driving, make sure you go over all of the details surrounding your case and take the best approach to increase your odds of a more favorable outcome.
